Swipe Album Cleaner Membership Services Agreement

This Agreement is a valid contract between Kongmuhu (Beijing) Technology Co., Ltd. (the “Platform”) and the party using its membership services (including but not limited to individuals and teams) (the “User”) concerning use of the Platform’s services and related services. To use the membership services of Kongmuhu (Beijing) Technology Co., Ltd. (the “Services”), please read, understand, and comply with this Membership Services Agreement (this “Agreement”). This Agreement is entered into by you and the provider of the membership services and has the force of a contract. It contains clauses that exempt or limit liability (“Disclaimer Clauses”), clauses that restrict user rights (“Limitation Clauses”), and clauses on dispute resolution and jurisdiction. Please read them carefully. Confirming those clauses may result in passivity, inconvenience, or loss in certain situations. Please read this Agreement again before you agree to it or use the Services.

1. Definitions and explanations

• 1.1 [Member and account]
  To use and enjoy Swipe Album Cleaner services, you need to use an account you are lawfully entitled to use, or a third-party login account, as your membership account, and after purchase you will enjoy the membership services and benefits corresponding to the purchased quota. You are then a Swipe Album Cleaner user. In these terms you are also referred to as “you”, “User”, or “Member”.

• 1.2 [The Services]
  Swipe Album Cleaner services means membership benefits and featured services that Members may enjoy exclusively on the Swipe Album Cleaner platform. Specific content is as described on the Swipe Album Cleaner store pages.

Swipe Album Cleaner may amend these terms at any time (including changing, adding, or reducing clauses). Once amended, the updated terms will be shown on the relevant pages. If you disagree with an amendment, you may stop using the Services. Continued use of services provided by the Platform is deemed acceptance of all amendments.

• 1.3 [This Agreement]
  • 1.3.1 This Agreement and the Membership Services Agreement form a unified whole. The Swipe Album Cleaner Resource Center Use Agreement is a supplemental agreement. The Platform may also publish related agreements and business rules for the Services from time to time. Once officially published, they form an integral part of this Agreement and bind both parties.

2. Account management and rules of use

• 2.1 [Account management]
  • 2.1.1 You must use, keep, and maintain your account and password properly. If leakage, loss, theft, or similar occurs and is not caused by the Platform’s fault, you bear all losses;
  • 2.1.2 You grant the Platform related rights for account security. The Platform may periodically or from time to time check and verify the security of your account in different ways, including but not limited to contacting you for identity verification, SMS verification, email authentication, and password changes. If you cannot complete verification or refuse without a legitimate reason, the Platform may reasonably suspect that the account is abnormal or stolen, and may suspend services to that account or take further measures.
• 2.2 [Rules of use]

  • 2.2.1 [Lawful acquisition and use]

    • Swipe Album Cleaner services are limited to use on the Swipe Album Cleaner platform. Any cracking, reverse translation, transcription, or other illegal means of separating the services from the platform is not a Swipe Album Cleaner service under these terms. The Platform reserves the right to pursue legal liability and claim damages.
    • Any Swipe Album Cleaner services obtained by theft, exploiting system vulnerabilities, or any unofficial or unauthorized channel (including but not limited to purchase, rental, borrowing, sharing, or assignment), or membership services obtained by maliciously exploiting or undermining Swipe Album Cleaner activities, are not protected. The Platform may cancel or refuse to provide membership services. All resulting losses and liabilities are borne by the actor.
    • Use of Swipe Album Cleaner services and/or participation in related activities must be through official published or authorized means. Services (including but not limited to accounts and membership benefits) or activity rewards (including but not limited to physical/virtual gifts and membership benefits) obtained through any other channel, path, or method are not protected. Upon discovery, the Platform may immediately delete, cancel, or zero out related services, or take other account measures such as suspending or terminating services. All resulting losses and liabilities are borne by the actor.
    • When participating in membership activities, you must follow the activity rules and act lawfully without harming the organizer. Obtaining benefits by exploiting system vulnerabilities, rule defects, system configuration errors, or abuse of membership status is not protected. The Platform may take related measures. All resulting losses and liabilities are borne by the actor.

  • 2.2.2 [Exclusivity and purpose of use]

    • Subject to these terms and applicable laws, the Platform grants you an exclusive license to Swipe Album Cleaner services. You may use them only for private purposes.
    • You understand and agree that you must not provide a Platform account that enjoys membership services to others in any way, including but not limited to transfer, rental, lending, sharing, or sale, for sharing, uploading, browsing, downloading, using/enjoying membership benefits, participating in activities, or similar. You bear any resulting legal consequences and liabilities, and the Platform may suspend or terminate services to you.

  • 2.2.3 [Independent accounts]

    • If the same person holds multiple Platform accounts and signs in to Swipe Album Cleaner, each account is treated as independent.
    • Purchase records, resources, and quotas cannot be transferred, migrated, assigned, gifted, sold, rented, or shared between accounts, even if the same person owns them. Please distinguish accounts when signing in and/or purchasing or joining activities to avoid loss. The Platform may suspend or terminate services as appropriate. You bear resulting losses.

  • 2.2.4 [Account recovery]

    • If account information used to sign in to Swipe Album Cleaner is lost or you forget the password and cannot sign in, recovery requires you to follow the official recovery process and provide corresponding information and proof that is lawful, true, and valid. If materials are untrue or do not meet requirements and fail security verification, recovery may fail. You bear the corresponding risks and losses. You understand that acting on and handling your request takes a reasonable time. Except where the Platform is legally at fault, the Platform is not liable for your losses.

3. Content of membership services

• 3.1 [Membership benefits]

  • 3.1.1 After you activate membership, you will enjoy the corresponding service experience and quota settings based on your purchase records and related activities, as published on the relevant service pages and as actually provided.
  • 3.1.2 All benefits you may enjoy after purchasing Swipe Album Cleaner are as published on the official website. The Platform may change all or part of membership benefits based on business needs. Adjustments will be shown on the corresponding service pages. You may also check the latest benefits on the official website. We encourage you to review this Agreement regularly to better protect your rights.

• 3.2 [Virtual products]
  Due to the nature of virtual products, virtual products you obtain (including Swipe Album Cleaner and items purchased through Swipe Album Cleaner promotions) cannot be returned, exchanged, or redeemed for cash, and may not be used commercially, such as for sale, swap, or mortgage. Virtual products and derivative services obtained through unofficial channels are not protected. The Platform may suspend or terminate services to you. You bear resulting losses.

• 3.3 [Device and system differences]
  After you activate the Services through Platform-designated channels, the specific services you can actually use may differ because of software (including browser) version, device, operating system, or other third-party reasons. You understand any resulting inconvenience and will not pursue or will waive related liability of the Platform.

• 3.4 [Fees]
  The Services are paid services of the Platform. You may use them only after paying the applicable fees. The Platform may modify benefit details, fee standards, and methods according to overall planning, and will show such changes on the corresponding service pages. The Platform may offer different discounts at different purchase or renewal stages, as published on the relevant service pages. Please note that updates to renewal status and charging standards may be delayed; the renewal contract status and charging standard at the time of actual payment prevail. We encourage you to review this Agreement regularly. You understand and agree that, depending on the activities you join, members may enjoy different value-added services or rates.

• 3.5 [Payment]

  • 3.5.1 You should pay as agreed through Platform-designated methods, including but not limited to WeChat Pay or other methods the Platform designates now or in the future.
  • 3.5.2 You must not activate the Services for yourself or others by any of the following:
    • activating the Services for yourself or others for profit, business, or other non-personal use;
    • activating the Services for yourself or others through any robot, spider, crawler, spam software, or other program or software;
    • activating the Services for yourself or others by any improper means or in a way that violates good faith;
    • activating the Services for yourself or others through a method not designated by the Platform;

• 3.6 [Refunds]
  Swipe Album Cleaner states that after you pay, it does not accept any form of refund request, except where a technical cause of the Swipe Album Cleaner product results in duplicate charges at purchase, or a technical cause prevents you from enjoying the purchased service. In those cases, please submit a refund complaint within 7 days. After verification, Swipe Album Cleaner may process a refund, but you must provide corresponding information and cooperate. If you do not complain within that period, Swipe Album Cleaner will treat the purchase as having no issue. You understand and accept the above. If you do not accept it, please consider carefully before choosing paid services.

• 3.7 [Service term]

  • 3.7.1 The term of the Services is the term you select and pay for. You may also check it on the corresponding pages of the Services.
  • 3.7.2 You understand, acknowledge, and agree that the service period includes reasonable time needed for the Platform to fix faults, repair, adjust, or upgrade servers, and handle third-party infringement. Time used for those purposes is not additionally compensated;

• 3.8 [Rules of use and notes]
  To provide better platform services, Swipe Album Cleaner may adjust membership benefits, including but not limited to:

  • adjustments to membership benefits and quota details;
  • changes to payment methods, prices, and the like;
  • other changes published by the Platform.

4. Liability for breach

• 4.1 [Breach]
  While using the Services, you must not:

  • violate laws, regulations, rules, ordinances, or any other legally binding norms;
  • disrupt or affect the Platform’s provision of the Services to any third party;
  • endanger computer network security;
  • adversely affect services or activities provided under these terms by the Platform and related third parties (including licensors and partners), or infringe the legitimate interests of the Platform, related third parties, and/or other users;
  • be determined by a competent authority to have infringed any third party’s lawful rights and interests;
  • use the Services to obtain illegal benefits, including but not limited to improper profit through resale, assignment, or sublicensing;
  • otherwise infringe the Platform’s lawful interests;

• 4.2 [Handling of breach]
  You confirm and agree that after discovering a breach, the Platform may take one or more of the following measures:

  • delete, block, or disconnect related information by technical means;
  • suspend or terminate part or all of the Services;
  • deduct membership benefits during the period of the breach;
  • restrict rights such as download, playback, copying, or storage;
  • the Platform need not refund any fees to you; unused service fees shall belong to the Platform as liquidated damages; you bear loss of related membership benefits and shall also compensate the Platform for its losses (including but not limited to attorneys’ fees and litigation costs);

• 4.3 [Compensation]
  If a user’s breach or illegal act causes losses to the Platform and its affiliates, including direct economic loss, reputational loss, and indirect losses such as compensation, settlement payments, attorneys’ fees, and litigation costs paid to others, the defendant shall compensate the Platform and its affiliates for all such losses. If your breach causes damage to any third party, you shall bear liability independently.

5. Change, suspension, and termination of services

• 5.1 Suspension or termination of the Services includes:

  • your active suspension or termination, including but not limited to failure to renew upon expiry;
  • the Platform actively suspending or terminating services because of your breach;
  • the Platform suspending or terminating services due to requirements of the state or relevant authorities, or force majeure;
  • other cases where laws and regulations or the Platform’s business adjustments require or need suspension or termination;

• 5.2 After services are suspended or terminated, if you cannot sign in or enjoy the services, you may contact online customer service.

• 5.3 Handling after suspension or termination:

  • 5.3.1 Except for liability provided by law, the Platform is not liable to the user or any third party for suspension or termination of the Services;
  • 5.3.2 Fees already collected will in principle not be refunded;
  • 5.3.3 For ongoing platform transactions, the Platform will reasonably decide whether to continue or terminate them, and whether to refund or deduct related fees as liquidated damages;
  • 5.4 If Swipe Album Cleaner changes service content, service methods, or this Agreement as provided herein, and you disagree, you may cancel and stop using all or part of the corresponding services already obtained; if you continue to use the services, you as a Member are deemed to have accepted the adjustments.
  • 5.5 If you disagree with an amendment to the terms, you may actively request termination of membership services from Swipe Album Cleaner, but fees from activation through the month in which you request termination will not be refunded; if you continue to enjoy membership services, you are deemed to have accepted the amendment.
  • 5.6 You agree that, due to the nature of internet services, the Platform may, on lawful grounds, modify, change, interrupt, or terminate part or all of the services, or change, delete, or transfer content you store or publish on Swipe Album Cleaner (collectively, “Change Acts”). The Platform reserves the right to take such Change Acts without notifying you, and you agree that services provided under these terms may be changed, interrupted, or terminated without prior notice. You also agree that the Platform is not liable to you or any third party for any loss caused by Change Acts.

6. Disclaimer

• 6.1 You know and agree that content uploaded, created, or published by users on the Swipe Album Cleaner platform is the user’s personal conduct. The Platform is not liable for the accuracy, authenticity, availability, security, integrity, or legitimacy of such information and content, and you hereby waive additional related liability of the Platform.
• 6.2 When you use, create, share, download, or otherwise deal with related information and content (“Use Conduct”), you should exercise independent judgment and use it lawfully. The Platform is not liable for any harm to yourself or to third parties caused by your Use Conduct.
• 6.3 If your account or property in the account is lost or reduced due to communication line failure, network or computer failure, system instability, force majeure (such as server downtime), or other causes not attributable to the Platform, you have no right to require the Platform to compensate.
• 6.4 Except as clearly provided by law, the Platform is not liable for any personal or financial loss, damage, or injury you suffer while using services provided by Swipe Album Cleaner. The Platform is not liable for any personal data leakage resulting from your disclosing your password to others or sharing a registered account.

7. Notices

• 7.1 Under this Agreement, all notices from the Platform to users may be given by website announcement or ordinary mail, and are deemed delivered on the date sent. To receive notices, you should keep the contact details you provided correct and valid, and promptly update them in Swipe Album Cleaner after any change. If you fail to provide correct contact information or to notify new contact details in time, you bear resulting losses and legal consequences. The Platform may deliver notices by one or more of the above methods. Such notices may have a material effect on you, whether favorable or unfavorable. Please ensure your contact details remain valid and pay timely attention.

8. Governing law and jurisdiction

• 8.1 The formation, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the People’s Republic of China.
• 8.2 If any dispute arises concerning this Agreement or its performance, the parties shall try to resolve it amicably; if that fails, either party may file a lawsuit with the people’s court at the place where the Platform company is located.
• 8.3 Failure by the Platform company to exercise or enforce any right or provision of this service agreement does not constitute a waiver of such right.
• 8.4 If any provision of this Agreement is wholly or partly invalid or unenforceable for any reason, the remaining provisions remain valid and binding.
• 8.5 To the extent permitted by laws and regulations, Swipe Album Cleaner has the right to interpret this Agreement.

If there is any conflict between a non-Chinese version and the Simplified Chinese version, the Simplified Chinese version prevails.
