Welcome to the products (including but not limited to the website and mobile clients) and services of Kongmuhu (Beijing) Technology Co., Ltd. (referred to in this Agreement as “Swipe Album Cleaner”).
To use Swipe Album Cleaner products and services, please read these terms carefully and agree to this statement.
Any direct or indirect use of Swipe Album Cleaner services or data will be deemed unconditional acceptance of this statement in full. If you disagree with any term of this statement (including but not limited to the privacy policy, intellectual property, information and data, and disclaimers), please stop using all content and services provided by Swipe Album Cleaner.
1.1 You agree to use the services only for the licensed purposes of this Agreement and only to the extent permitted by applicable law, regulation, or generally accepted practice in the applicable jurisdiction.
1.2 If your use of the services or other conduct, whether intentional or not, threatens the ability of Swipe Album Cleaner to provide the services or other systems, Swipe Album Cleaner may take all reasonable steps to protect the services and its systems, which may include suspending your access. Repeated violations may lead to termination of your account.
1.3 Swipe Album Cleaner services continue to evolve. The form and nature of the services may change from time to time without notice. Swipe Album Cleaner may also stop providing the services (or any feature) to you or to users, permanently or temporarily, and may not be able to give prior notice. We also reserve the right to limit use and storage at any time in our discretion without notice.
3.1 Information that may be generated or discovered through use of the services includes data files, device characteristics, written text, software, music, graphics, pictures, images, sound, video, information, and other similar materials. You understand that all content, whether published publicly through the services or transmitted privately, is the responsibility of its originator. This means you, not Swipe Album Cleaner, are fully responsible for any content you upload, download, post, email, transmit, store, or otherwise make available through the services. Any use of or reliance on content or materials published or obtained through the services is at your own risk.
3.2 We do not endorse, support, represent, or warrant the completeness, truthfulness, accuracy, or reliability of any content or communication published through the services, or endorse any opinion expressed through the services. You understand that by using the services you may be exposed to content that is offensive, harmful, inaccurate, or inappropriate, or that in some cases may be mislabeled or deceptive. In no event is Swipe Album Cleaner liable for any content, including but not limited to any errors or omissions in any content, or any loss or damage arising from use of any content emailed, transmitted, or otherwise made available through the services or broadcast elsewhere.
4.1 You may obtain the software from the Swipe Album Cleaner website or from a third party authorized by Swipe Album Cleaner.
4.2 If you obtain the software, or an installer with the same name, from a third party not authorized by Swipe Album Cleaner, Swipe Album Cleaner cannot guarantee that the software will work properly and is not responsible for any resulting loss.
4.3 Swipe Album Cleaner may develop different versions for different devices. You should download and install the version that matches your situation.
4.4 After downloading the installer, you must follow the steps prompted by the program to install it correctly.
4.5 If you no longer need the software or need to install a new version, you may uninstall it yourself. If you are willing to help Swipe Album Cleaner improve the product, please tell us why you uninstalled.
4.6 To improve experience and service content, Swipe Album Cleaner will keep developing new services and may provide software updates from time to time (which may take the form of replacement, modification, feature enhancement, or version upgrade).
4.7 To keep the software and services secure and consistent, Swipe Album Cleaner may update the software without special notice to you, or change or limit some features or effects.
4.8 After a new version is released, older versions may no longer work. Swipe Album Cleaner does not guarantee that older versions will remain usable or that related customer service will continue. Please check and download the latest version from time to time.
5.1 Intellectual property in content you publish or display publicly on the services belongs to you. You grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, process, adapt, modify, publish, display, and distribute such content in any and all media or distribution services (now known or later developed).
5.2 You agree that this license includes the right of Swipe Album Cleaner to provide, promote, and improve the services, and to provide content submitted through the services to other companies, organizations, or individuals that cooperate with Swipe Album Cleaner for syndication, broadcast, distribution, or publication, for use on other media and services, subject to our terms and conditions for such use.
5.3 Such additional uses by Swipe Album Cleaner or cooperating companies, organizations, or individuals may not result in any compensation to you for content you submit, publish, transmit, or otherwise make available through the services.
5.4 We may modify or adapt your content in order to transmit, display, or distribute it over computer networks and various media, and/or make changes so that the content conforms to the requirements or limitations of any network, device, service, or medium.
5.5 You are responsible for use of the services, use of any content you provide, and the consequences (including use by other users and our third-party partners). You understand that your content may be syndicated, broadcast, distributed, or published by our partners. You must not infringe others’ intellectual property or other rights, including copyright. Swipe Album Cleaner is not liable for use of your content under these terms. You represent and warrant that you have all rights, power, and authority needed to grant the rights herein for any content you submit.
5.6 You may also report offensive content to us.
6.1 You acknowledge and agree that Swipe Album Cleaner and/or its licensors own all legal right, title, and interest in the services (including but not limited to graphics, user interface, scripts, and software used to operate the services) and any software provided to you as part of or in connection with the services (the “Software”), including any and all intellectual property therein, whether registered or not and wherever in the world. You further agree that the services (including the Software and any other part) contain proprietary and confidential materials protected by applicable intellectual property and other laws (including copyright law). You agree not to use such proprietary information or materials except to use the services in accordance with this Agreement. Except as expressly permitted, no part of the services may be copied in any form or by any means.
6.2 Except for use of the services permitted in this Agreement, any use of the Software or any part of the services is strictly prohibited. Such use infringes others’ intellectual property and may subject you to civil and criminal penalties for copyright infringement, including possible damages.
6.3 Swipe Album Cleaner grants you a personal, worldwide, non-transferable, non-exclusive license to use the Software provided as part of the services. The sole purpose of this license is to enable you to use and enjoy the benefit of the services in the manner permitted by these terms.
7.1 Your use of the software is deemed to mean you have read and agree to be bound by this Agreement. Swipe Album Cleaner may amend these terms when necessary. You may review the relevant terms in the latest version of the software. If you continue to use the software after the terms change, you are deemed to have accepted the amended Agreement. If you do not accept the amended Agreement, you should stop using the software.
7.2 If any provision of this Agreement is wholly or partly invalid or unenforceable for any reason, the remaining provisions remain valid and binding.
7.3 This Agreement may exist in multiple languages, including Chinese and English. If there is any conflict between the Chinese version and another language version, the Chinese version prevails.
7.4 Headings in this Agreement are for convenience only, shall be ignored when interpreting this Agreement, and shall not be used as a basis for interpreting its terms.
